Refunds

AI Accuracy

Limitation of Liability
To the maximum extent permitted by law, Cortyxia Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Cap on Liability
Our total liability to you for all claims arising from or relating to these terms or our services shall not exceed the amount you have paid to Cortyxia in the twelve (12) months preceding the claim.
Termination
Termination by You
You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, your right to use the services will immediately cease.
Termination by Cortyxia
We may terminate or suspend your account immediately, without prior notice, for any reason, including but not limited to breach of these Terms, fraudulent activity, or violation of applicable laws.
Effect of Termination
Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.
Indemnification
You agree to indemnify, defend, and hold harmless Cortyxia Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the services
- Your violation of any term of these Terms
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right
- Any claim that your use of the services caused damage to a third party
Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Arbitration
Any dispute arising from or relating to these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
Class Action Waiver
You and Cortyxia agree to resolve any disputes through individual arbitration and waive any right to participate in class actions, class arbitrations, or representative proceedings.

These Terms constitute the entire agreement between you and Cortyxia regarding the subject matter hereof and supersede all prior or contemporaneous agreements, communications, and understandings.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. Cortyxia may assign these Terms at any time without restriction.
